Is there anyway to revert back so my tabs/Panels are always in front of documents.

Can you take a screenshot of this for us? What operating system are you using?
OSX 10.7.3
Try Window > Arrange > Consolidate all into tabs.
That does work but I don't use tabs as I need certain files open next to each other. Seem a strange thing to have documents in front of panels/tabs.

Turning off the Application Frame may help, too. Window > Application Frame.
