Batch Processing error - using paths

I need to batch process mutiple files where 'select Path1/copy/paste' is part of the action. All images contain a path named Path 1 but the action is only working on 30% of the images - can anyone help me understand why?

I'm using PS 5.1 on a mac.

    Are you using Tabbed view?

If not, try it (e.g., Choose Window - Arrange - Consolidate All to Tabs).  There's a Photoshop bug with coordination of action operations when multiple window view is used.

Can you post a screenshot of the action with all the steps open?

Do you know what part of the action fails?

Do all the images have a Background layer?

(the step in your action to Select layer 'Background")

At the bottom of the batch dialog you could set the Errors to Stop for Errors and that might narrow it down.

Or specify a place to write the Error log file and then look at that.

Did the action work okay in a previous photoshop version?

    Added: I'm using windows 8

When the action has failed with some file(s) when running a batch, can the action succeed if it is applied to a known failure file by manually opening the file and playing the action?

I can not see the whole action steps can you make the action palette wider so we can see everything recorded. If your batching why is there an open step? Since all documents contain a path 1 the files being open must be a PSD, PSB or a Tiff, layered document what was their saved active layer that is being duplicated and do they all have pixels in the selected path 1 area.  Look like you save over the original file if you did set set an output folder and you do not tell us how the action fail do all document have a new layer added that are what should have been the selected pixels that get copied and pasted and are all saved documents active saved layers now the white filled background layer?  if not the save did not save.
