android tablets OS 3.x vs 4.x menu bar

On the Motorola Xoom family edition, pulling the screen resolution does not account for the OS 3.x honeycomb bar across the bottom (in landscape mode at least).

I did however test a few newer android tablets running 4.x and it did return the correct visibe bounds of the screen.

 

Does anyone have specific way they handle this other than if (3.xxx OS){ estimate honeycomb bar }
