what CSS code would you use, to make a div that is used for a vertical menu stick to the bottom, just above the footer, when the menu is not long enough by its self, can someone help please thank you Jeff.

The normal procedure would be to have a faux background image sitting behind the menu <div>.
The background image would be attached via css to a wrapper <div> that should enclose your menu <div> and all the other <divs> on the page.
Does that make sense?
Another method would be to use javascript. I've never used that method though as it seems a little like over kill to be.
Another method I guess would b eto use the css property display:table; on the <divs> (I think IE8 supports that) Again it's not a method that I have much experience with and would need testing.

By the way I had to set the site width to 970px because of the width of the spry bar at the top, that’s 970px whatever I do, any way it’s all line up now.
