How can I save a preset in cs5.5 to be compatible with cs3 and above?

It can't be done. Animation presets are version specific and just liek project files not backward compatible.

what about videocopilot's presets? like AfterShake which work with mutliple versions of after effects?

They created them in older versions, no doubt.
