I don't see any differnce here in the behavior between Photoshop and InDesign. If docked panels are expanded to remain open they stay behind floating panels, but if they are collapsed and opened from the icon they will come forward when clicked.

In your second screen shot I can see that the character panel goup has been opened by clicking on the docked icon, but I can't tell how the panels are arranged fromthe first screen shot. Panels opened from the docked icon, as in the second example, should come forward. If the panel is docked in the oen position it will not. Does your Adjustments panel come forward in Photoshop as things are arranged in the screen capture?
