If that works, the problem is some other software that is "hijacking" your burner so Encore can't properly "talk" to it to burn

The error was there in CS4 when you try to burn a DVD Disc from a DVD folder. I do not know if this is the same error or not because this is not clear to me from your post how you are building a DVD.
To make a DVD disc from a folder, we select the Source to be DVD Volume and then give the path of the folder.
One point must be noted here that the path we give should be the path of the folder only not the path of the Video_TS folder in that folder.
I think this point is mentioned in "Testing and building the final project" in help file for Encore.
