Yes you are taken to the top layer after opening a file whether that layer is locked or not.
Illustrator does remember what was hidden and locked.

I've never seen it do that in an active file in the decades I've worked in illustrator. My experience has always been that you can do a quick cmd-s while working and nothing changes, including Layer focus, as long as the file remains open and active.

This is definitely wrong. You may start at the top of this list and see how far you need to go:
1) Close down Illy and open again;
2) Restart the computer;
3) Close down Illy and press Ctrl+Alt+Shift/Cmd+Option+Shift during startup;
4) Move the folder with Illy closed;
5) Look through and try out the relevant among the Other options;
Even more seriously, you may:
6) Uninstall, run the Cleaner Tool if you have CS3/CS4/CS5, and reinstall.

If you close eveything down during beer time, you will already be through 1) and 2) so you can start with 3) tomorrow (over here we are well into tomorrow now so it feels like today), if needed.
