I don't think it matters, but I just want to be sure you're not focused on it "materializing" in your project, as opposed to not being able to get rid of it. (When not added by the user, it is generally added in error as a default menu. Undoing it right away seems okay. Deleting later is sometimes one of the scenarios where it becomes a phantom menu.)
If you've looked at many of the threads here, you know that there's no guaranteed workaround other than starting the project over. The easiest workaround is to ignore it and hope yours is one of the projects that works fine.

Since it is the default menu, I may have accidentally clicked one in, but I suspect that I didn't since it never showed up in the Project tab. At any rate, it's there, and it doesn't seem to hurt anything once past the warning when build the disc. Rather not recreate since I have 3 menus each with the max number of buttons...sheesh!

I know this is a very fast operation and user has not enogh time to cancel the import of a menu but sometimes when system is slow or encore is busy doing something else, then this can happen and in that case, the menu never disappears. But I have tried burning by ignoring the warning message and I did not face any problem in playback.
