Does this happen when actually running a batch using File>Automate>Batch or even when running the recorded action on one image inside photoshop?
Did you try as an experiment using a different filter in place of the skin softening step to see if the filter might be the cause?

Do you do that by fading the effect or lowing the layers opacity, If you lower a layers opacity in an action the layer's opacity will change. However it you then flatten the image you wind up with a single background layer. Background layers do not support transparency all background layers are 100% opaque.
