Saving .psd as .pdf

I have trouble saving my .psd as .pdf. It looks that when I save it as .pdf the layer that was suppose to be on the top it shows below, If you look at psd attachment and compare it to pdf attachment you will see the difference.

Any help would be appreciated

I re-saved my .psd to new name (to keep my original work) and merge all layers. Then saved it as .pdf and it looks alright now

Can you paste a full size screen shot of your workspace showing the layers panel?

It might be useful to know your Photoshop version, and operating system.

Are you leaving the layers intact before saving out to PDF?

I can see that file was saved as .psd but when I go back to cs5 i see this "error"...
