I just tested it, and a) "send to back" does not make a layer the background and b) dragging from the project panel will not make it the background. And you can't select and clear the background.
Add your image to the library (it must be a psd), then add it as the background for your menu.

Adding to library is still a lot better than re-installing CS.

Select the layer and go to Object menu and choose Arrange->Send to Back or use the keyboard shortcut "Command+Shift+["
