with illustrator open, I am dragging the scan to the Illustrator icon on the dockinmg station.
Illustrator reopens and i release the scaen onto the opened document.

with both documents open, drag the layer of the Photoshop scan onto the open Adobe Illustrator document.
(...and I promise not even to ask why you're doing that. )

Reason is I dont want to save the image then either place or open it in Illy and then delete it.
too many steps, faster just to drag it, done
It works with CS3.

That's what I have been trying to tell you since post #1.
