Here is a larger screenshot. I am experiencing this error in both CS5 and CS6. Here is a shot from CS6 experiencing a similar issue where the paint brush and eraser stop working completely. It seems this problem occurs ocassionaly after using the transform tool, I hit ctrl t adjust something with transform, hit enter and then the tools stop working
I noticed hitting ctrl+d to deselect fixes the problem, even though after hitting enter on the tranform there is no active selection. Not sure whats going on behind the scenes here.

Honestly it looks as though everything is in order. It's maybe a bit less common to be painting on a transparent layer than painting on a solid layer, but clearly it works for you some of the time.
Only thing I can think of is to try resetting the Brush Tool to see if that helps bring function back (right click in the little brush icon near the upper-left corner), and also checking to see if any display driver updates may be available. What video card do you have? I ask, because if it's ATI you probably want Catalyst 12.8 drivers, specifically, rather than any newer ones.
I assume you're sketching using a tablet. You might also want to check to see if maybe the problem is that pen pressure is being lost somehow. Does the cursor move? What happens if you then try to use the mouse to paint a stroke?
