Doesn't help with the copy/paste issue, but why not place the AI file?
I could and I may have to, but I wanted to be able to manipulate the paths in InDesign. In this case it’ll be easier than having to edit in Illustrator, synchronise swatches, etc, and update the link. I’m drawing them by scripting in Scriptographer, so I can’t just create them in InDesign.
It’s not a huge deal—I could just place the AI file—but it’s annoying and adds a few unnecessary steps and may be a bigger problem for future work.

Try pasting in smaller groups selected from the illustration (you won't be able to manipulate the .eps anyway).
The AI file seems to be corrupted in some way. There’s no other indication that there’s anything wrong with it, but I was getting the error even if I tried an single rectangle path. I couldn’t seem to copy and paste anything across from AI to ID.
I’ve created a new AI document and I can copy accross from that without any trouble, so I’ve copied my original paths into that document first, then across to ID.
