I don't believe this problem is a graphic driver issue either for this reason. I am able to open up 3DS MAX and use either DirectX or OpenGL for the viewport renderers. So, 3dsmax works fine with DirectX but Director reverts to software only.
I believe that the problem is not that Vista can't do DirectX. It can.
But it can only do very reecent versions of DirectX (9 and 10 I
believe). 3DS Max uses DirectX 9, I think. Director uses DirectX 5 or 7,
neither of which are supported under Vista.
Either Vista will need to be changed to increase backward compatibility
or Director will need to have the ability to use a newer version of

Looks like Vista works with DirectX 8 and 9. In 3DS MAX, you can set the viewport to use either of these two api's and they both work under Vista.

just use OpenGL
opengl doesn't work either nor would we use it if it did for a variety of reasons.
