I'm sorry, but this appears to be a bug in the current version of the Adobe Color Swatches panel.
It looks like the Set Selection button only works in Photoshop—it takes the active color in the theme and sets it as the Photoshop foreground color.
What the heck? I'm not trying to use Kuler at all
You don't have to use Adobe Color Themes (formerly Kuler) panel to select color—you would use it to choose sets of harmonized colors and then move those sets over to the swatches panel for use in layout (Add to Swatches Panel).
If you simply want to choose color you can use the Color Picker (double-click Fill in Tools), the Color panel, or the Swatches panel—Swatches lets you apply and edit color globally.
The Color Theme panel isn't currently color managed, so if you use it you'll want to choose Lab as the color mode.
I'm having the same problem & it worked in a previous version, so yes, seems to be a bug in 10.2.0.69.
I get around it by typing the hex, CMYK (or RGB) color values for the selected color into the number boxes. Copying & pasting it as hex is easiest, since it's only one number. Seems to work, but still it would be great if you could once again just touch the button.
Now, that all the colors in swatches produced from Adobe Color Theme seem to be transferred to ID swatches as RGB is yet another issue… not a big deal to change to CMYK, but a pain none the less.
Thank you! I like this solution. I haven't had the problem of the themes showing up in the Swatch panel as hex, though. Did you click on CMYK at the bottom of the Color Themes panel? For me, that selection stays highlighted all the time unless I change it. Also, if you typed your swatch values in CMYK it might help you stay in CMYK.

The panel will take CMYK values but their appearance is not color managed. This thread shows the color shifts.
Apparently changes were made at the backend of the Adobe Color website to fix the problem. If you try clicking Set Selected Color from Active Color icon under the color wheel, it should now work.

I'm having the same problem. When I try to use the color picker in InDesign to sample a color from an imported image to use in Adobe Color, I get the same error. Adding the sampled color to the Swatch palette doesn't work in either RGB or LAB modes. Clicking Set Selected Color from Active Color icon under Adobe Color's color wheel doesn't work, either. Any other suggestions?
