need help checking blown highlights in javascript.

I run a script that opens stacks from bridge as layers in photoshop then runs an action to mask the blown out highlights of the top layer.

My problem occurs when the top photo of the stack does not have any blown out highlights, then the action throws an error (Cannot make a mask because there is no selection) This causes my entire batch process to hang.

I can't seem to suppress error dialogs in my script so I thought perhaps I could check the top photo of the stack before sending to photoshop -- and if there are no blown highlights, then I wouldn't even run the action (or - better still, run a different action)

any thoughts on how this could be done?
