Are you a creative cloud subscriber? If you are, you can easily add themes to your library and then access them directly in all your apps.
I am a creative cloud subscriber. When I go in to my Themes the only actions available to me are "publish", "edit" and "delete". I can't "favourite" or "download" any themes as the options aren't there.
Neither can I access any of my themes via illustrator - not sure if I can do it directly from Photoshop or InDesign?
I'd like to know also how to download the swatches and I don't have CC nor do I intend on subscribing.
Sorry about the trouble. The way you add themes to a library is a little unintuitive. We're working to make it really easy to add to library. Until then, I'll explain how to do it.
Step 1: On the explore page (or theme page) click the "Edit Copy" icon.
Step 2: If you want to make any edits, you can do so on the next page that loads (the Color Wheel). Once you are done making changes, click the "Save" button.
Step 3: Give your theme a name, and select the library you wish to save it in.
Now, the theme will show up in your Libraries in your apps. In most apps, you can access Libraries by navigating to Window > Library.

This doesn't answer the question: why can't I download the swatches?
We used to be able to do this when this service was "kuler" - why has it been changed to make it LESS user friendly?

The download function is no longer available. Creative Cloud Libraries is the mechanism Adobe is using to share assets across apps. If you don't have a CC membership, it's doable, but not as easy.
Option 1: You will have to copy the RGB, HEX, etc. and paste the values into the app you are using.
Option 2: If you have CS6 or earlier, you can use the "Kuler" panel to access "public" colors and use them in your app.
