What version of Photoshop are you using?
Only Photoshop CS2 supports the ASE file format.
Did Chris' question address your concern? Are you running a version of Photoshop other than CS2?
They weren't some of the .ase.xml files?
I had trouble loading .ase files also -- I have Photoshop CS2 on a PC -- most files have an .ai extension.
I think i finally got the .ase files loaded. How do I get just the .ase swatches loaded with out showing all the other colors?

uhm, i'm using CS2 on tiger, and i have that problem too... the system recognizes it correctly as an .ase file with the icon and all the stuff, but it just won't load into my illustrator…
May I ask how you are loading this into Illustrator? Are you importing the .ASE file via the Swatches palette: Options-->Swatch Library-->Open Swatch Library-->Other Library? If yes, what kind of error are you getting?
I am having the same trouble opening ASE files downloaded from Kuler in Photoshop CS2 on OS X Tiger. When I load the ASE file from the swatches pallet, I receive an "unexpected EOF encountered" error. I opened up the ASE file in a hex editor, here are the contents:
41 53 45 46 00 01 00 00 00 00 00 05 00 01 00 00
00 0A 00 01 00 00

Which theme are you trying this with? I'll test it here as well.
I think I have solved your .ase download problem. I was trying to download the .ases using Firefox 2 on my Mac, however I was getting the same error, unexpected EOF.
Then I thought, I'll try Safari and see how that goes. They load into InDesign fine.
My fee for this is $120 per hour :)
