"The command (x,y,z) is not currently available"

I am currently running the Geometric Art Action and have named my first layer background and my second layer area as seen on this tutorial: Geometric Art Photoshop Effect Tutorial - YouTube . Despite this I am constantly getting "The command (x,y,z) is not currently available". What have I done wrong?

A condition requited to use delete does not exist like something targeted to be deleted.  The a typical error message you get when something a command requires depend on does not currently exist.  In the case I would think the action's prior would have targeted layer 5 to be deleted but it Layer 5 is the only layer left in the document you most likely can not delete it. A document most likely needs to have a layer. What does the layers palette look like????
