Maybe u've tried it already, but give the flash menu an high z-index number.
When u build the same nav bar with layers (show\hide options) u need to set the layers that are hidden an higher z-index number, so I don't really know how it works with flash, but check that the opening flash menus has an higher z-index number than the movie under the menu.

Flash will always float to the top, regardless of z-index.

Fantastic, I had read this Tech not the other day, however i altered the wmode in flash, this time i set the perameter in dreamweaver.

This is definitely not a z-index issue.
All Active content on a page will always rise to the top, so to speak,
including Flash, certain form elements, Java applets, and Active X controls.
This means that each of these will poke through layers. There is not a good
cross-browser/platform reliable way to solve this issue, but if you can be
confident in your visitors using IE 5+ or NN6+, then you can use the Flash

Wmode does not work reliably on Apple computers. Just thought you should

Nor does it work in Opera if that matters.
