In some new documents I can use scatter brushes. In others the scatter brushes are greyed out in the brush pallete menu and I cannot select them. I've also seen something similar with pattern brushes. But I haven't been able to identify the document property which enables/disables those brush types.
Presuming you have created (and selected) at least one path in each new document, what happens if you select all (Ctrl/Cmd+A) and paste into yet another new document (Ctrl/Cmd+A)?

I created a new "print" document and created a path using the rectangle tool; made sure it was still selected. The scatter brush option was grey'ed and unavailable in the brushes pallette. I opened another document that had scatter brush paths already in it. I selected a path and copied it; then pasted it into the new document I created. The path correctly showed up in the new document, and all scatter brushes became available in the pallette.
I'm still not sure why the document gets created with scatter brushes disabled, but hopefully that experiment will be meaningful to a reader here.

What is the Document Color of the two different files? It may be that you have RGB scatter brushes and are trying to use them in a CMYK document.
