Were you using a third party plugin?
Yes, but the modal message, which was not caught, was from indesign itself, asking for fonts which were not on the system.
The modal state property is still there.
The following js works in CS4...

It should be something like this:
tell Application InDesign CS4
set modal_state to modal state
Is it possible that the way modal windows are treated has changed? seems that the windows that are telling that resources or fonts are missing are not part of the "modal"-windows anymore. Is there any description telling what belongs to the modal windows? And is there are way to catch windows like the "missing resources"-windows in a dialog?
I tested it on a missing font alert, and it works correctly.
FWIW, in CS4, there's a preference option that you can use to disable checking for links when you open a document.
