That's a good question. Optional payment (i.e. a donation) does not appear to be covered by our Kuler API documentation, so I've forwarded this on to the team that can make that determination.

Hi, thanks for your patience and for your interest. The terms on the API Key Request Form page at kuler.adobe.com/api (log in to view) state the following:
This non-commercial API key is for non-commercial entities for any or all of the below purposes:
* Internal development or testing
* Services that are not commercial in nature
* A service that is not bringing in any money or charging any money (and will not in the future)
