Could you post a screenshot of the file (with Options Bar and Layers Panel visible) it fails working on?
Maybe you are on an empty Layer and have not checked »Sample All Layers« …
I can capture the image in CS4 and wallah the back ground is gone...here in CS5 I have to had draw it (which I did just rapidly for this example) then I go to refine edge get the black screen with white outlines...or using the background screen image I just get the blank background with a light outline of the image ...????
What do you mean by the Quick Selection Tool "doesn't work" ?
Is it the Quick Selection Tool that is not working as expected or the Refine Edge? What tool did you use to "draw" the flower selection in your screen shot, and why?
Please explain what is not working more clearly.
I don’t quite follow – which View is the one resulting in black?
Have you tried checking Auto-Enhance?
I am using the Quick select tool. The same one I use in CS4
The black image is what I get after I select the image and then hit refine edge
It is like the whole image everything but the lines are deleted.
Which View Mode > View have you chosen in the dialog?

I would like to inform you that this is a known issue and it can be fixed by following these steps:
Re-creating the Photoshop CS4 preferences file restores settings to their defaults.
To re-create the Photoshop CS5 preferences file:
1. Quit Photoshop CS5.
2. Rename the Users\[username]\Library\Preferences\Adobe Photoshop CS5 Settings\Adobe Photoshop CS5 Prefs.psp folder to Adobe Photoshop CS5 Prefs.old.
3. Start Photoshop CS5. Photoshop creates a new Adobe Photoshop CS5 Prefs.psp file.
If trashing the prefs is necessary one can also start the application with the command-alt-shift-keys pressed and chose th eappropriate option in the dialog that appears.
