Nested List is not nested if in last list item

In other words, if I have this list in FrameMaker:

1. First item
2. Second item
   • Sub 1
   • Sub 2
3. Third item
   • Sub 1

and I link the FM file to RH, the topic shows up as separate lists in the HTML. The 3 numbered items appear just fine, but the final Sub 1 item is its own unordered list.

If I add another item to the numbered list:

1. First item
2. Second item
   • Sub 1
   • Sub 2
3. Third item
   • Sub 1
4. Fourth item

then all the items are properly handled in the parent OL item.

Has anyone figured out a workaround to this. I'm really trying to avoid RH Multilevel Lists, so solutions focusing on HTML lists are most appreciated!
